Class action launched following Capital One data breach

The Capital One data breach which exposed personal details of 6 million Canadians and around 100 million in the US has led to a lawsuit.

Canadian law firm Charney Lawyers has launched a class action on behalf of Canadians whose information was compromised in a cyber incident earlier this year.

The information, which included around 1 million social security numbers, relates to credit card applications made between 2005 and 2019.

The claim alleges that Capital One's credit card application includes customers’ names, addresses, birthdates, email addresses, primary telephone numbers, social insurance numbers, mothers’ maiden names, and financial information including whether the applicant owns or rents, annual pre-tax income, other household income, mortgage status, monthly rent or mortgage payment, and whether the credit card will be used for cash advances.

"The account information is highly sensitive,” says lead counsel Ted Charney. “In the wrong hands it can be used to commit identity fraud or to cause damage to your credit reputation. If released online it could be very embarrassing.”

Capital One says that it will make free credit monitoring and identity theft insurance available to everyone affected.
